1. Overview
This Acceptable Use Policy ("AUP") sets forth the rules and guidelines governing the use of the ShadeCalc platform (the "Service"). This AUP is incorporated into and forms part of the ShadeCalc Terms of Service. By accessing or using the Service, you agree to comply with this AUP. Violation of this AUP may result in suspension or termination of your account and may subject you to civil or criminal liability.
2. Prohibited Activities
You agree that you will not, and will not permit any third party to, engage in any of the following prohibited activities in connection with the Service:
Unauthorized Access
Attempting to gain unauthorized access to the Service, other user accounts, computer systems, or networks connected to the Service through hacking, password mining, brute force attacks, social engineering, or any other means. Accessing or attempting to access any data belonging to other users without their explicit authorization. Circumventing, disabling, or otherwise interfering with any security features or access controls of the Service.
Scraping and Automated Access
Using any automated means, including but not limited to robots, spiders, scrapers, crawlers, data mining tools, or similar technologies, to access, monitor, copy, or extract data from the Service. Making excessive API calls, automated requests, or other actions that place an unreasonable load on the Service's infrastructure.
Copying and Reverse Engineering
Copying, reproducing, duplicating, or replicating any portion of the Service, including its software, code, algorithms, user interface, design, or functionality. Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, underlying algorithms, data structures, or trade secrets of the Service. Creating derivative works based on the Service or any portion thereof.
Reselling and Redistribution
Reselling, sublicensing, leasing, renting, or otherwise providing access to the Service to any third party who is not an authorized user under your account. Using the Service to provide a competing service or to build a product that replicates the functionality of the Service.
Account Sharing
Sharing your individual login credentials with any person who is not an authorized user under your account. Allowing multiple individuals to use a single user account simultaneously. Creating accounts using false, misleading, or fraudulent information. Creating multiple accounts to circumvent usage limits, free trial restrictions, or other account limitations.
Unlawful Use
Using the Service for any purpose that is unlawful, fraudulent, deceptive, or harmful. Using the Service to generate false, misleading, or deceptive quotes, estimates, or documents. Using the Service in connection with any activity that violates applicable federal, state, or local laws, regulations, or ordinances.
3. Account Sharing and Access
Each user account is for the exclusive use of the individual to whom it is assigned. Login credentials are personal and non-transferable.
The Account Owner (Super Admin) is responsible for managing user access within their organization, including adding, removing, and assigning roles to team members.
The Service supports up to five (5) users per company account. Each user must have their own individual account with unique login credentials.
The Account Owner is responsible for ensuring that all users within their organization comply with this AUP and the Terms of Service.
4. Data and Security
You are responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account.
You agree not to attempt to access, view, download, or modify data belonging to other users or other company accounts.
You agree not to upload, transmit, or store any content that contains viruses, malware, or other harmful code through the Service.
You agree not to use the Service to collect, store, or process personal information of third parties in violation of applicable privacy laws.
5. Enforcement
ShadeCalc reserves the right to investigate any suspected violation of this AUP and to take any action it deems appropriate, including but not limited to:
- Issuing a warning to the violating user;
- Temporarily suspending the violating user's account;
- Permanently terminating the violating user's account;
- Removing or disabling access to any Content that violates this AUP;
- Reporting the violation to law enforcement authorities;
- Pursuing civil or criminal legal action against the violating user.
ShadeCalc's decision regarding enforcement actions shall be final and binding. ShadeCalc shall have no liability for any action taken pursuant to this Section.
